NYGOP Chair Ed Cox has issued a statement following the acquittal of Daniel Penny. The verdict, according to Cox, represents "a victory for justice and a testament to the enduring courage of ordinary New Yorkers who refuse to stand idly by in the face of danger." He praised Penny as "a Marine who stepped up to protect his fellow citizens on a subway system that has become a symbol of lawlessness under Democratic leadership."
Cox criticized New York's justice system, suggesting it has been compromised by political influences. He stated, "It is not just about Daniel Penny: it is about a legal and political framework that Albany Democrats have corrupted to serve their radical agenda." Cox accused Albany Democrats of undermining the rule of law by blocking Governor Kathy Hochul’s nominee for Chief Judge and appointing Rowan Wilson, whom he described as an "openly progressive judicial activist."
He expressed concern over what he termed as "judicial corruption," which he believes encourages judges to prioritize progressive ideologies over impartiality. This was evident in the Penny trial, according to Cox. He argued that the judge's decision to dismiss the manslaughter charge narrowed the scope of justice due to an activist judicial climate.
Cox also criticized Alvin Bragg's prosecution of Penny, calling it politically motivated and detrimental to public safety. He stated that such actions send "a chilling warning" that acts of courage could make individuals targets in today's New York.
