New York's 'equal protection' amendment faces criticism ahead of November ballot

In Case You Missed It, the New York Post published an article on July 28, 2024, by Wai Wah Chin discussing New York’s “Equal Protection of Law Amendment,” which is set to appear on November’s ballot after a prolonged journey through the courts.

Public comments on what will be listed as Proposition One closed last Friday, and the state Board of Elections is finalizing its language. The amendment has been presented by Democrats as essential for protecting abortion rights in New York following the Supreme Court’s 2022 Dobbs decision.

However, critics argue that this "Equal Protection" law is misleading. "But as we can expect from Democrats — remember the deceptively named federal 'Inflation Reduction Act'? — this 'Equal Protection' law is anything but," wrote Chin.

The left promotes Proposition One as crucial for safeguarding abortion rights in response to the Dobbs decision. However, according to opponents, Dobbs did not ban abortion; it clarified that the Constitution does not address abortion's legality and left states free to determine their own laws. Critics assert that additional abortion protection in New York is unnecessary.
