Two men face federal charges for illegal re-entry after arrests near Buffalo

Two men have been charged with illegal re-entry into the United States following separate incidents in Western New York, according to a statement released by U.S. Attorney Michael DiGiacomo.

Evaristo Calixto Miranda Lopez, 37, originally from Guatemala, was encountered by law enforcement officers in Cheektowaga, New York on November 2, 2025. Authorities report that Miranda Lopez attempted to flee but was apprehended and detained. He did not possess any legal status or immigration documents permitting him to remain in the country. Records indicate he had previously been removed from the United States twice in 2019.

Jairo Anain Roman Murillo, 26, a native of Honduras, was approached by law enforcement on October 29, 2025 in Hamburg, New York. He also fled but was located after an extensive search and found hiding in nearby woods. Roman Murillo lacked documentation authorizing his stay in the United States and had previously been deported in November 2019.

Both defendants appeared before U.S. Magistrate Judge Michael J. Roemer and are currently being held pending further proceedings.

U.S. Attorney Michael DiGiacomo stated: “The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.”

The charges stem from an investigation conducted by U.S. Border Patrol Buffalo Station under Patrol Agent-in-Charge David Banks. The cases are being prosecuted by Assistant U.S. Attorney Sasha Mascarenhas.

This action falls under Operation Take Back America—a national initiative led by the Department of Justice aimed at addressing illegal immigration, dismantling criminal organizations involved with transnational crime, and safeguarding communities against violent offenders.

If convicted of illegal re-entry charges, each defendant faces up to two years imprisonment and a possible fine of $250,000.
