Rochester man receives 10-year sentence for new child pornography conviction

Marcobrien S. Volcy, a 28-year-old resident of Rochester, New York, has been sentenced to 10 years in prison for possessing child pornography after previously being convicted under New York State law for a similar offense. The sentence was handed down by Chief U.S. District Judge Elizabeth A. Wolford, according to an announcement from U.S. Attorney Michael DiGiacomo.

Assistant U.S. Attorney Katelyn M. Hartford explained that Volcy had pleaded guilty in August 2023 in Monroe County Court to possessing material involving the sexual performance of a child younger than 16 and received a one to three year prison sentence at that time. While on probation following this conviction, authorities found that on January 19, 2024, Volcy possessed a cell phone containing images and videos of child pornography.

Investigators determined that Volcy had more than 650 images and videos depicting child pornography on his device, including content featuring prepubescent children.

“The sentencing is the result of an investigation by the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge Philip Tejera,” according to the press release.
