Prior felon pleads guilty to new federal child pornography charge

Marcobrien S. Volcy, 28, of Rochester, New York, has pleaded guilty to possession of child pornography after a previous conviction for a similar offense under New York State law. The announcement was made by U.S. Attorney Michael DiGiacomo. Volcy entered his plea before Chief U.S. District Judge Elizabeth A. Wolford.

According to Assistant U.S. Attorney Katelyn M. Hartford, in August 2023, Volcy pleaded guilty in Monroe County Court to possessing a sexual performance by a child less than 16 years old and received a sentence of one to three years in prison. While on probation for this conviction on January 19, 2024, Volcy was found with a cell phone containing more than 650 images and videos of child pornography, including material depicting prepubescent children.

The investigation leading to the plea was conducted by the Federal Bureau of Investigation under Acting Special Agent-in-Charge Mark Grimm.

Sentencing is set for January 14, 2026, before Judge Wolford. The charge carries a mandatory minimum penalty of ten years in prison and could result in up to twenty years’ imprisonment and a fine of $250,000.
