Niagara County man indicted on federal charges for alleged sex crimes involving a minor

A federal grand jury has indicted Joshua Mahley, 42, of Gasport, New York, on six counts related to sexual offenses involving a minor. The announcement was made by U.S. Attorney Michael DiGiacomo in Buffalo.

According to Assistant U.S. Attorney Colleen M. McCarthy, the indictment alleges that Mahley traveled across state lines on three occasions in June, July, and August 2025 to engage in illicit sexual conduct with a minor victim. In September 2025, he is accused of transporting the minor across state lines for sexual activity. On September 8, 2025, Mahley allegedly possessed computer and AI-generated images depicting minors engaged in sexually explicit acts.

Mahley was previously convicted in December 2010 in Orleans County Court for Rape in the Second Degree and Sexual Abuse in the Second Degree. He is a registered sex offender in New York State.

The investigation leading to the indictment was conducted by the Niagara County Sheriff’s Office and the Federal Bureau of Investigation.

“The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty,” stated officials.

If convicted of these new charges—interstate travel to engage in illicit sexual conduct, transportation of a minor, penalties for registered sex offenders, and possession of obscene visual representations—Mahley faces up to life imprisonment.
