The New York State Department of Agriculture and Markets (AGM) has announced a webinar aimed at helping farmers prepare for the 2025 Farm Employer Overtime Credit Advance Program. The refundable tax credit is available to eligible farm employers who paid overtime wages after January 1, 2025, as part of the ongoing reduction in the overtime threshold in New York.
The informational session will take place on Friday, July 25, from 2:00-3:00 pm. It will provide an overview of the program, outline changes for 2025, include a demonstration of the application system, and offer a question-and-answer segment. Farmers interested in applying can do so beginning August 1, with applications due by September 30. Applicants are encouraged to review requirements and register their farms or authorized representatives through AGM’s website at agriculture.ny.gov/farming/farm-employer-overtime-credit-advance.
After submitting an application to AGM for a certificate covering eligible overtime paid between January 1 and July 31, applicants whose eligibility is confirmed will receive a certificate of payment. Those using Professional Employer Organizations (PEOs) in 2024 may also apply for eligible overtime paid throughout that year. With this certificate, approved farm employers or business owners can then request payment from the New York State Department of Tax and Finance via its online services account before November 1.
To qualify for this refundable credit, applicants must be eligible farmers who either directly employ qualifying farm employees paid overtime or pay such wages indirectly through PEOs.
According to AGM, “The Farm Employer Overtime Credit is part of Governor Kathy Hochul’s plan to support New York’s farmers through a series of new and increased tax credits and other initiatives and helps to ensure that farm employers can continue to support their workers while reducing their tax burden.”
