Immigration and Customs Enforcement (ICE) announced that Marcio Martins-Rodrigues, a Brazilian national previously deported and currently in the U.S. illegally, is facing removal proceedings following a rape indictment involving a minor.
According to WRGB CBS 6 Albany, 35-year-old Brazilian citizen Marcio Martins-Rodrigues was arrested by Cohoes Police on August 24, 2025, following an investigation into the reported sexual assault of a minor. On August 27, he was indicted by an Albany County grand jury on charges of first-degree rape involving forcible compulsion and second-degree rape of a victim under 15 years old. The CBS 6 report also confirmed that ICE records showed Martins-Rodrigues had previously been deported from the United States and had reentered unlawfully.
As reported by WNYT NewsChannel 13, Martins-Rodrigues had been deported previously and returned to the U.S. illegally, which triggered ICE to open new removal proceedings. ICE confirmed that they issued a detainer, a formal request that the Albany County Correctional Facility hold him until federal officers can assume custody.
