Ecuadorian man sentenced for illegal re-entry after removal from United States

Segundo Juan Maynato-Guaman, a 46-year-old citizen of Ecuador, pleaded guilty to the charge of re-entry of a removed alien in Rochester, New York. The plea was entered before U.S. District Judge Frank P. Geraci, Jr., and Maynato-Guaman was sentenced to time served before being handed over to Immigration and Customs Enforcement.

According to Assistant U.S. Attorney Nicholas M. Testani, on June 25, 2025, Border Patrol Agents in Rochester stopped the vehicle driven by Maynato-Guaman at Brockport-Spencerport Road and Washington Street. When asked about his citizenship status, he replied “Ecuador.” He provided agents with a New York State identification card under the name Segundo Mainato-Guaman and admitted to being present in the United States illegally, stating “yes, I do not have any documents.” A records check revealed that Maynato-Guaman had been physically removed from the United States in December 2009.

U.S. Attorney Michael DiGiacomo stated that this case is part of Operation Take Back America. According to DiGiacomo: “This case is part of Operation Take Back America, a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime.”
