United States Attorney for the Southern District of New York, Jay Clayton, along with Ricky J. Patel, Special Agent in Charge of the New York Field Office of Homeland Security Investigations (HSI), and Francis J. Russo, Director of the New York Field Office of U.S. Customs and Border Protection (CBP), announced charges against Miguel Francisco Mora Nunez and Christhian Aybar-Berroa. The charges are related to the shooting of an off-duty CBP officer on July 19, 2025, in Manhattan.
“Gun violence will not go unanswered,” stated U.S. Attorney Jay Clayton. “Our office will relentlessly pursue anyone who threatens the safety of New Yorkers and the federal officers sworn to protect them.”
Ricky J. Patel emphasized HSI’s commitment to justice: “Today’s announcement underscores HSI New York’s tireless commitment to answers, and ultimately justice on behalf of our DHS family.” He assured that no stone would be left unturned as they seek a speedy recovery for the CBP officer.
Francis J. Russo commended the bravery shown by their officer during the incident: “His quick and decisive actions taken not only saved the officer’s life but also saved the life of his girlfriend.”
The complaint alleges that Mora Nunez shot an off-duty CBP Officer in Fort Washington Park, Manhattan. The officer returned fire before Mora Nunez fled on a motorbike driven by Aybar-Berroa.
Both individuals are charged with crimes related to illegal possession and accessory after the fact due to their unlawful status in the United States.
Jay Clayton expressed gratitude towards law enforcement partners for their assistance in this case.
Assistant U.S. Attorney Mostafa Khairy is leading the prosecution under allegations that remain unproven until guilt is established in court.
