Buffalo man receives over 10 years for role in fatal fentanyl overdose

Antonio Gutierrez, a 29-year-old resident of Buffalo, New York, has been sentenced to 132 months in prison following his conviction for possession with intent to distribute fentanyl. The sentence was handed down by U.S. District Judge Lawrence J. Vilardo.

According to Assistant U.S. Attorney P. Richard Antoine, the case stems from an incident on December 9, 2022, when an individual identified as C.R. was found deceased from a drug overdose at his home in Orchard Park, New York. Authorities recovered several items from the bedroom where C.R. was discovered, including his cell phone, suspected fentanyl, and drug paraphernalia.

Investigators determined that Gutierrez’s DNA was present on a glassine envelope collected at the scene. They also found that C.R. had frequent communications with a phone number associated with Gutierrez in the hours leading up to his death and that both individuals’ phones were located in the same area of Buffalo during this period.

U.S. Attorney Michael DiGiacomo announced the sentencing and noted that the investigation involved Homeland Security Investigations and the Orchard Park Police Department.
