U.S. Attorney Michael DiGiacomo has announced that Timothy Tundo, a 62-year-old resident of Bethany, New York, has pleaded guilty to several charges. These include possession with intent to distribute LSD, possession of firearms in furtherance of drug trafficking, and unlawful possession of machine guns. The charges could result in a minimum sentence of five years and up to life imprisonment.
The case is being handled by Assistant U.S. Attorneys Joshua A. Violanti and Stacey Jacovetti. They reported that in February 2021, law enforcement executed a search warrant at Tundo’s residence in Bethany. The property was reportedly used for the manufacture and distribution of controlled substances. During the search, authorities seized quantities of LSD, oxycodone, marijuana, two machine guns, three assault weapons, 12 long guns, five pistols, a cap gun, ammunition, magazines, $2,500 in cash, and drug paraphernalia.
The investigation leading to this plea was conducted by the Genesee County Sheriff’s Office under Sheriff Joseph Graff’s direction and the Bureau of Alcohol, Tobacco, Firearms and Explosives led by Special Agent-in-Charge Bryan Miller from the New York Field Division.
Sentencing for Tundo is set for November 14th at 9:30 a.m., before U.S. District Judge Lawrence J. Vilardo.
