Alma Avenue gang member brothers charged with new federal drug and gun offenses

Kevin Miller, 35, of Buffalo, New York, and his brother Kaylen Miller, 28, of Lackawanna, have been arrested on new federal drug and gun charges. The announcement was made by U.S. Attorney Michael DiGiacomo.

Kevin Miller faces charges for possession with intent to distribute and distribution of five grams or more of methamphetamine. This charge carries a mandatory minimum sentence of five years in prison and could result in up to 40 years and a $5 million fine. Kaylen Miller is charged with being a felon in possession of a firearm and possession with intent to distribute crack cocaine. If convicted, he could face up to 20 years in prison and a $1 million fine.

According to the criminal complaints, Kevin Miller was arrested after making two controlled sales of methamphetamine to an undercover officer. Authorities stated that since 2019, the FBI Safe Streets Task Force has been investigating Kevin Miller’s alleged drug trafficking activities. He is identified as an Alma Avenue Gang member with a previous federal narcotics conviction.

Kaylen Miller’s charges stem from a search warrant executed by law enforcement that led to the recovery of a loaded handgun, suspected cocaine, drug paraphernalia, and $2,005 in cash. Investigators determined that the handgun had been reported stolen in Cleveland, Ohio. Due to a prior felony conviction, Kaylen Miller was prohibited from possessing firearms.

U.S. Attorney DiGiacomo said: “Kevin and Kaylen Miller have a documented history of criminal behavior, which they have both been prosecuted and punished for in the past. These brothers clearly did not learn a lesson the first time around and are now being held accountable once again for their actions. Let these newest charges serve as a reminder that my Office, together with our law enforcement partners, will continue our efforts to keep defendants like the Miller brothers from filling our community with drugs, guns, and violence.”

Philip Tejera, Special Agent-in-Charge of the FBI’s Buffalo Field Office added: “Kevin and Kaylen Miller are previously convicted felons, who, once again, find themselves in federal custody. These arrests and seizures demonstrate our relentless determination to remove gun and drug-fueled violence from our city. The FBI’s Safe Streets Task Force is proud to work side by side with the Lackawanna and Buffalo Police Departments, and the U.S. Attorney’s Office to bring these individuals to justice.”

Assistant U.S. Attorney Donna Duncan reported that both men appeared before U.S. Magistrate Judge Michael J. Roemer on Tuesday; Kevin Miller was ordered detained while Kaylen Miller was released under certain conditions.

The investigation involved cooperation between the Federal Bureau of Investigation (FBI), Buffalo Police Department led by Commissioner Alphonso Wright, and Lackawanna Police Department led by Chief Mark Packard.

Authorities emphasized that criminal charges are accusations only; defendants are presumed innocent unless proven guilty.
